Silver Hills Bakery

“The Sprouted Life Challenge with Silver Hills Bakery” (the “Contest”) is sponsored by Vibrant Health Products, Inc. PO Box 2250, Abbotsford, BC, V2T 4X2, Canada (the “Sponsor”). This Contest is governed by these Official Rules, which are available online at www.silverhillsbakery.ca/contest. Entering the Contest constitutes any entrant’s full and unconditional acceptance of these Official Rules. This Contest is void where prohibited by law.

NOTE: Although the Contest may be communicated, promoted, or administered by means of a third party social media or social networking service or site such as those operated by Facebook, Inc. and Instagram, LLC (each a “Third Party Service Provider”), the Contest is in no way sponsored, endorsed or administered by, or associated with, any Third Party Service Provider, and any questions, comments or complaints regarding the Contest should be directed to the Sponsor and not to any Third Party Service Provider. 

CONTEST PERIOD: The Contest entry period begins at 12 a.m. PT on January 9, 2024 and ends on April 30th, 2024 at 11:59 p.m. PT (the “Contest Period”).

ELIGIBILITY: The Contest is open to residents of Canada (Residents of the province of Québec are eligible to receive a coupon, but not to enter the giveaway) and the United States who have reached the age of majority in their province, state or territory of residence at the time of entry. Employees, directors, officers, representatives, mandataries or contractors of the Sponsor and immediate family members of, and any persons domiciled with, any such persons, are not eligible to enter the Contest. The Sponsor reserves the right to require any entrant to provide proof of identity, age and eligibility to enter the Contest, and to disqualify any entrant where such identity, age and eligibility cannot be verified.

NO PURCHASE NECESSARY TO ENTER THE CONTEST OR WIN THE PRIZE. A PURCHASE WILL NOT IMPROVE THE CHANCES OF WINNING. All entries have an equal chance of wining the Prize. 

CONTEST ENTRY INSTRUCTIONS: 

1. How to Enter. 

Via Contest Landing Page: Follow the prompt to sign up for the Silver Hills Bakery Newsletter on the Silver Hills Bakery “The Sprouted Life Challenge” Landing Page (“Landing Page”) during the sweepstakes period, located a http://silverhillsbakery.ca/sprouted-life-sign-up/.  Once you have signed up for the Silver Hills Bakery Newsletter, you will receive a four email series. On the 4th email of the series, there will be a prompt to fill out a testimonial and relevant contact information. The contestant is required to complete all mandatory fields in the testimonial form in order to be qualified for a free product coupon and be entered into the contest for the grand prize.  

SELECTION OF CONTEST WINNER/ODDS: 1 potential winner will be chosen by 1 random draw and the draw will take place 7 days after the end of the Contest Period. The odds of winning will depend on the number of eligible entries received for the Contest. Upon selection of the potential winner, the Sponsor will send a message via email address provided by the potential winner in the Official Entry Form email address provided by the potential winner in the Official Entry Form, and the potential winner will have 48 hours to respond. If no response is received within 48 hours, such potential winner will be disqualified and he/she forfeits any eligibility for a prize.  Another potential winner will then be chosen in accordance with these Official Rules. The Sponsor is not responsible for Prize fulfillment nor for any technical failures relating to the Contest. 

Prior to confirming a potential winner, the Sponsor in its sole discretion may verify the winning entry and the potential winner’s eligibility. The Sponsor will only contact the potential winner via email address provided by the potential winner in the Official Entry Form.  

Before being declared the winner (the “Winner”), the potential winner must first correctly answer a mathematical skill-testing question, without assistance of any kind, whether mechanical or otherwise. If the potential winner incorrectly answers the skill-testing question, the potential winner will be disqualified and forfeits any eligibility for the Prize. The Sponsor may elect to select another potential winner in accordance with these Official Rules if any potential winner is disqualified.

PRIZE:

The Prize will not be replaced if lost or stolen. The Prize is not assignable, transferable, or redeemable for cash. Except as otherwise permitted under these Official Rules, no substitutions allowed; however, the Sponsor reserves the right to substitute any portion of the Prize with another item of equal or greater value for any reason whatsoever. The Prize is provided without any warranty of any kind. The Sponsor will sent the Prize directly to the Winner.

For U.S. residents only: All federal, state and local taxes on the value of the Prize and other charges, if any, are the responsibility of the Winner. All other expenses of the Winner not specifically mentioned herein are not included as part of the Prize and are solely the Winner’s responsibility.  The Winner must complete and provide to the Sponsor any tax forms or other information requested by the Sponsor in connection with any tax filing obligations.

COUPON DISTRIBUTION:

PUBLICITY: As a condition of entry into the Contest, except where prohibited by law, the Winner, by accepting the Prize, grants to the Sponsor and its affiliates, legal representatives, assigns and licensees, the permission and right to publicize, broadcast, display, and/or otherwise use the Winner’s first name and last name initial, city, province, biographical material, likeness, or other personal information  in any media, known now or hereafter, throughout the world in perpetuity for advertising and publicity purposes, without additional review, compensation, permission, or approval of the winner, except where prohibited by law. 

ALTERNATIVE MEANS OF ENTRY: A person may also enter the Contest by mailing a standard-size postcard with the person’s name and email address to: Silver Hills Bakery, Marketing Department, PO Box 2250, Abbotsford, BC, V2T 4X2. Postcard entries must be received during the Contest Period to be included in the random drawing, and no more than one entry per person may be submitted during the Contest Period. 

GENERAL RULES: By entering in the Contest, entrants agree to be bound by these Official Rules, and by the decisions of the Sponsor, which are final and binding in all respects. The Sponsor is not responsible for: (1) any incorrect or inaccurate information or technical failures of any kind; (2) unauthorized human intervention in any part of the entry process or the Contest; or (3) any other computer, network, technical, human, or other error, problem, or malfunction that may occur in connection with the administration of the Contest, the processing of entries, or the selection or notification of winners. Further, if, for any reason, the Contest is not capable of running as planned for reasons outside the control of the Sponsor, which, in the sole opinion of the Sponsor, may corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Contest (or portion thereof), the Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify, or suspend the Contest (or portion thereof). 

DISQUALIFICATION: The Sponsor also reserves the right, at its sole discretion, to disqualify the entry of any individual found to be (a) ineligible to enter the Contest, (b) tampering or attempting to tamper with the entry process or the operation of the Contest or any website operated by the Sponsor or any Third Party Service Provider (including, without limitation, the Silver Hills Bakery Facebook page); (c) using any robotic, macro, automatic, programmed, or like entry methods, which will void all such entries; (d) violating these Official Rules or the terms of service, conditions of use, and/or general rules of the Sponsor or any Third Party Service; or (e) acting in an unsportsmanlike or disruptive manner or with intent to annoy, abuse, threaten, or harass any other person. The Sponsor is not responsible for claims, injuries, losses, or damages of any kind resulting, in whole or in part, directly or indirectly, from the awarding, delivery, acceptance, use, misuse, possession, loss, or misdirection of the Prize; participation in the Contest or in any activity or travel related thereto or from any interaction with, or downloading of, computer Contest information. CAUTION AND WARNING: ANY ATTEMPT TO DELIBERATELY DAMAGE THE SPONSOR’S WEBPAGE OR UNDERMINE THE LEGITIMATE OPERATION OF ANY CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES TO THE FULLEST EXTENT PERMITTED BY LAW.

RELEASE AND LIMITATIONS OF LIABILITY: Except where prohibited by applicable law, by participating in the Contest, each entrant agrees to release and hold harmless the Sponsor, any Third Party Service and their respective related companies, parents, subsidiaries, affiliates, and their respective agents and agencies, promotional partners, prize providers and partners, and their respective officers, directors, employees and agents (collectively, the “Released Parties“) from and against any claim or cause of action arising out of participation in the Contest or use of the prizes, including, but not limited to: (a) unauthorized human intervention in the Contest; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) errors in the administration of the Contest or the processing of entries; (e) late, lost, stolen, illegible, inaccurate, delayed, misdirected or undeliverable entries, posts, mail or emails; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest. Each entrant further agrees that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Contest and in no event shall the Released Parties be liable for attorney’s fees. Each entrant hereby waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

PARTICIPANT OBLIGATIONS: By participating in the Contest, each entrant agrees to be bound by these Official Rules and the decisions of Sponsor. Before accepting the Prize, a potential winner agrees to execute and return a legal declaration and release (the “Release”) that, among other things, (i) confirms the potential winner’s eligibility for the Contest and compliance with these Official Rules; (ii) acknowledges acceptance of the Prize as offered; (iii) releases the Releasees from any and all liability for any loss, harm, damages, cost or expense arising out of or resulting from, in whole or in part, directly or indirectly, from the entrant’s participation in the Contest, participation in any Contest related activity or the acceptance, use or misuse of any prize, including but not limited to costs, injuries, losses related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light, or from any and all claims arising from the Contest. 

GOVERNING LAW: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrants and the Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of British Columbia and federal laws of Canada applicable therein, without giving effect to any conflict of law rules.  Each entrant agrees that any and all disputes, claims, and causes of action arising out of, or connected with, the Contest or the Prize shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court in British Columbia.

PERSONAL INFORMATION: The personal information collected through the Contest will (i) be held by the Sponsor in accordance with the Sponsor’s privacy policy (available at http://silverhills.wpengine.com/privacy-statement/), (ii) be accessible only to employees directly involved in the Contest, (iii) be used by the Sponsor for the purpose of (a) administering and operating the Contest, (b) internal analysis of the Contest; and (c) if the entrant opts in, to receive newsletters and promotional emails from the Sponsor and its affiliates (the “Purposes”); and (iv) not be disclosed to other persons except to fulfill the Purposes.  The Sponsor may also disclose personal information to any interested party, such as a Releasee, in accordance with these Official Rules or other documentation executed by any entrant in accordance with these Official Rules. Any entrant may access and obtain a copy of his personal information upon email request to the Sponsor at [email protected] or by calling 1.888.853.6466. By entering the Contest, each entrant consents to the Sponsor’s collection, use and disclosure of entry information as described in these Official Rules. Personal data entered online becomes the property of the Sponsor.
